Council intends to make a new By-law, to be known as the Public Places By-law 2025.

This is proposed to replace the former by-law, known as the Public Reserves and Public Buildings By-law, which expired in 2021.


The objective of the new By-law is to:

  1. Provide for fair and orderly use of public places;
  2. Provide for the health, safety, amenity and peaceful enjoyment of people in or on a public place; and
  3. Protect a public place against harm or damage.

The draft By-law is currently open for public consultation and feedback, which will be taken into account before Council considers a final report to make the By-law.

Copies of draft Public Places By-law, together with the Regulatory Impact Statement which explains the objectives and impacts of the by-law are available via the links above. Hard copies can also be obtained from the City Offices at 80 Wilson Street.

Feedback is invited from the public, on any aspect of the draft by-law and must be made in writing and addressed to the General Manager by either:

  • Returning a submission in writing to the General Manager, c/- Burnie City Council, 80 Wilson Street Burnie, or PO Box 973 Burnie, 7320; or
  • Sending a submission in writing addressed to the General Manager to governance@burnie.tas.gov.au with the subject line:  Proposed Public Places By-law

The consultation period closes on Monday 24 November 2025.
