EMERGENCIES
A temporary obstruction or occupation of a road in association with an emergency situation will not require a permit.
Full closure and occupation of a highway so as to prevent passage of pedestrians and vehicles will require an application and approval in accordance with requirements of Section 19 or Section 20 Local Government (Highways) Act 1982.
a) Street Activities: Street Stalls and the provision of Information, Promotion, Goods and Services
Street Stalls include:
- Street stalls with a charitable or community purpose;
- Stalls for the provision of advice, information or a service without charge to the general community in relation to charitable, community, educational, health, political or religious purposes;
- Street surveys and awareness campaigns;
- Access to a vending machine or a servery on land or premises having frontage to a Council street;
- Hawking of goods and services; or
- Retail trade or business activity only in conjunction with an approved event or promotion
b) Street Activities: Public Collections, Raffles, Fund Raising
Public Collections include:
- Selling of raffle tickets,
- The collection of donations and
- The operation of a street stall for fund raising.
c) Street Activities: Street Advertising-Signs
Public Collections include:
- the display of a freestanding and portable advertising signboard,
- flags,
- banners or
- bunting
d) Street Activities: Performances and Announcements
Performances and announcements include:
- busking,
- musical, artistic or dramatic entertainment,
- public announcements and
- provision of messages of a social, political, religious or environmental nature.
e) Work in a Council Street
Works in a Council Street include:
- opening road surface for connections to water supply, sewage, storm water drains, connections to electricity, communication cables, gas
- pipelines.construction/installation /repair of new or existing roads/footpaths,
- construction/installation/repair works occurring to buildings adjacent to road/ footpath.
f) Construction a Crossing-Driveway to a Council Street
Constructing Crossings include:
- permanent construction of a crossing or
- temporary placement of a crossing
- to or from the carriageway of a highway
- over a footpath,
- over a kerb and channel or
- over a table drain
g) Depositing of Materials in a Council Street
Depositing Materials include:
- tracking of material from land or premises adjoining the street, or
- the spillage of liquid or solid materials from a vehicle travelling on a local street.
h) Livestock on a Council Road
Livestock on Council Roads include:
- grazing,
- driving,
- holding and
- crossing of livestock

Background
The Burnie City Council may grant a permit to allow temporary occupation or obstruction of a part only of a Council street in association with the conduct of a public event, or with the conduct of building, construction maintenance or repair activity on adjoining land or premises, including the temporary storage of equipment or materials, and the placement of equipment, hoists and machines.
Any temporary occupation or obstruction of a street within the Burnie municipality must comply with the requirements in accordance with the Burnie City By-law No 10 – Highways. The By-law provides a means for managing and controlling a variety of activities that may occur within a local highway. The objective of the by-law is to ensure the function, safety and physical condition of local Highways/Roads/Streets within Burnie are protected.
Application for Permit
A person seeking to occupy or obstruct a Council street must first complete an Application for Conduct of an Activity or Work within a Council Street, and obtain a Permit from the Council.
Application for a permit must be made in writing and be accompanied by the following information -
- A statement describing the intended activity or work ;
- Details of location and extent of activity or work;
- Such other information as may be reasonably required to assist understanding of the intended activity, and its impacts. Dates time, and duration for the proposed activity should be clearly stated.
The Permit Application Form should be completed and submitted not less than ten (10) working days prior to the date for conduct of the activity for which a permit is required. If consultation with an external agency or a public notification is required submission time may be longer. This will enable assessment, request of additional information, and the determination, grant and preparation of a permit sufficiently ahead of the activity.
